1. The materials appearing on PROEXAM.ORG are the sole and exclusive property of Professional Examination Service (PES). The User may not copy, download, store, publish, transmit, transfer, sell, sublicense or otherwise use PROEXAM.ORG or any portion thereof, in any form or by any means without the prior written permission of PES.
2. All elements of PROEXAM.ORG including, but not limited to, text, articles, logos, trademarks, graphics, and overall "look and feel" are the property of PES. Nothing herein shall be construed to confer any license or right. The User acknowledges that PROEXAM.ORG is protected by copyrights, trademarks, service marks, patents, and other proprietary rights and laws.
3. PROEXAM.ORG IS PROVIDED "AS IS," WITHOUT WARRANTY OF ANY KIND, EXPRESSED OR IMPLIED. PES HEREBY DISCLAIMS ALL WARRANTIES, EXPRESSED OR IMPLIED, INCLUDING BUT NOT LIMITED TO, WARRANTIES OF PERFORMANCE, MERCHANTABILITY, AND FITNESS FOR A PARTICULAR PURPOSE.
4. The User agrees to hold PES, its employees, agents, and contractors harmless from any and all claims, costs, damages, judgments, and liabilities (including, but not limited to, reasonable attorney’s fees) arising from the use of PROEXAM.ORG.
